Terms of Service

These Terms of Service ("Terms") are an agreement between you and Bit Serenity Studios LLC ("we," "us"), a Colorado limited liability company. By downloading, installing, or playing our mobile games, including Cozy Coffee Merge (the "Games"), you agree to these Terms. If you do not agree, please do not use the Games.

1. License to play

We grant you a personal, non-exclusive, non-transferable, revocable license to install and play the Games on devices you own or control, for your own entertainment. The Games are licensed to you, not sold.

2. Ownership

The Games, including their code, design, artwork, names, logos, and all related intellectual property, are owned by Bit Serenity Studios LLC or used under license. You may not copy, modify, distribute, sell, reverse engineer, or create derivative works from the Games except where the law expressly permits it despite this restriction.

3. In-app purchases and virtual items

The Games may offer optional in-app purchases, such as virtual currency, items, or the removal of advertising. All purchases are processed by Apple or Google under their payment terms. Virtual items and currency:

• Have no real-world monetary value and cannot be exchanged for cash
• Are a license to use features within the Games, not property
• Are non-refundable except as required by law or by the policies of Apple or Google
• May be modified or discontinued if a Game is updated or retired

Purchases are tied to your Apple or Google account and can be restored on your devices through the platform's restore function. Purchase and progress records for platform-mediated purchases live with the platform, not with us.

4. Acceptable use

You agree not to cheat, exploit bugs for unfair advantage, use the Games for any unlawful purpose, or attempt to interfere with the Games' operation or other players' enjoyment. In particular, you agree not to:

• Submit scores that were not achieved by legitimate gameplay, or use tools, scripts, or modifications to inflate scores.
• Attempt to access, scrape, or otherwise interfere with the leaderboard database or its APIs outside of normal in-game use.
• Impersonate another person, our team, or a real organization using your Barista name.
• Post a Barista name containing hate speech, slurs, threats, harassment, sexually explicit content, or another person's private information.
• Use the Games to distribute malware, phishing content, or spam.

5. Leaderboards and Barista names

Cozy Coffee Merge includes an optional online leaderboard called Daily Brew. When you choose to submit a score:

• You may set a public Barista name that other players see next to your score.
• You are responsible for the Barista name you choose. Do not include your real name, email address, phone number, or other personal information in it. See the Privacy Policy for what is stored and how to request removal of your entry.
• By submitting a Barista name and a score, you grant Bit Serenity Studios LLC a worldwide, royalty-free, non-exclusive license to display them in the Game and in materials that promote the Game (such as store screenshots and social posts about the leaderboard).
• The Game applies a profanity filter to Barista names at submission. We may additionally remove, rename, hide, or reset any Barista name or leaderboard entry that violates these Terms or our community standards, at our discretion.
• To report an offensive Barista name or another player's conduct on the leaderboard, email contact@bitserenitystudios.com with "Leaderboard report" in the subject line. We aim to respond within two business days.
• Repeated or serious violations may result in a device-level ban from the leaderboard.

6. Updates, saves, and availability

We may update, change, suspend, or discontinue any Game or feature (including the leaderboard) at any time. We are a small studio and do not guarantee that any Game will be available or supported indefinitely. Game progress may be saved to your device and synced through your Apple or Google account; we are not responsible for loss of progress caused by device changes, platform account issues, or deletion of the app. Leaderboard entries may be removed if the leaderboard is retired, if entries are found to violate these Terms, or at your request.

7. Disclaimer of warranties

The Games are provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We do not warrant that the Games will be uninterrupted or error-free.

8. Limitation of liability

To the maximum extent permitted by law, Bit Serenity Studios LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Games. Our total liability for any claim relating to the Games will not exceed the greater of fifty US dollars ($50) or the amount you paid us through the Games in the twelve months before the claim arose. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

9. Termination

You may stop using the Games at any time by uninstalling them. We may terminate or suspend your license, remove your leaderboard entries, or block your device from the leaderboard if you violate these Terms. Sections 2, 5, 7, 8, and 10 survive termination.

10. Governing law

The Games are distributed worldwide through the Apple App Store and Google Play. These Terms are governed by the laws of the State of Colorado, USA, without regard to conflict of law principles. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Colorado, and you consent to their jurisdiction. If you live in a jurisdiction whose consumer protection laws grant you rights that cannot be waived by contract, nothing in these Terms limits those rights.

11. Changes to these Terms

We may revise these Terms from time to time. The current version will always be posted at this page with its effective date. Continuing to play after changes take effect means you accept the revised Terms.
